Terms of Service for SnapDash

Welcome to SnapDash! These Terms of Service ("Terms") govern your use of the SnapDash mobile application ("App") and its related services (collectively, the "Services") provided by JVW Retail ("we," "us," or "our").
By downloading, installing, accessing, or using the SnapDash App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.
By accessing or using our App, you confirm that you have read, understood, and agree to be bound by these Terms. You also acknowledge and agree that you are solely responsible for compliance with any applicable local laws.
SnapDash is a dashcam application designed to record video and audio, capture photos, and overlay GPS data directly onto your mobile device. Key features include:
Continuous video recording.
Event-based recording.
On-device storage of all media files (videos and photos).
Integrated gallery for playback and management of recorded media.
GPS speed and location data overlay.
a. Lawful Use: You are solely responsible for ensuring that your use of the SnapDash App complies with all applicable laws, rules, and regulations in your jurisdiction, including, but not limited to, laws regarding privacy, consent for recording audio/video, data protection, and distracted driving.
b. Privacy: You acknowledge that recording individuals, conversations, or private spaces without consent may be illegal in some jurisdictions. It is your responsibility to understand and adhere to such laws. We are not responsible for your actions or your compliance with laws relating to recording.
c. Distracted Driving: You acknowledge that operating a mobile device while driving can be dangerous and is illegal in many places. You agree to use the App responsibly and in compliance with all traffic laws and regulations. You understand that using this App does not negate your responsibility to drive safely and attentively.
d. Prohibited Content: You agree not to record, upload, or share any content that is illegal, harmful, abusive, defamatory, obscene, infringing, invasive of privacy, or otherwise objectionable.
e. Security: You are responsible for maintaining the security of your device and the media files stored on it.
f. No Developer Backup: All media files (videos and photos) are stored exclusively on your device. We do not collect, store, or back up any of your media files. You are solely responsible for backing up your own data. We are not responsible for any loss, corruption, or deletion of your media files.
g. Accuracy of Data: While the App attempts to provide accurate GPS data, its accuracy can be affected by various factors (e.g., device GPS limitations, environment, signal strength). You agree not to rely solely on the App for precise speed or location data.
a. Our Content: All intellectual property rights in the SnapDash App itself, including its design, text, graphics, and other content (excluding User-Generated Content), are owned by us or our licensors.
b. Your Content: You retain all intellectual property rights in the video recordings, photos, and any other data you create using the App ("User-Generated Content"). You grant us no license or rights to access, use, or store your User-Generated Content, as it remains exclusively on your device.
Your use of the SnapDash App is also governed by our Privacy Policy, which details how we collect, use, and protect your personal information (specifically information related to app usage, NOT your media files). THE SNAPDASH APP AND ITS SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT:
THE APP WILL OPERATE UNINTERRUPTED, SECURELY, OR ERROR-FREE.
THE QUALITY OF RECORDINGS OR DATA WILL MEET YOUR EXPECTATIONS.
YOUR MEDIA FILES WILL NOT BE LOST OR CORRUPTED DUE TO DEVICE ISSUES, APP MALFUNCTION, OR USER ERROR.
GPS DATA WILL BE ACCURATE OR AVAILABLE AT ALL TIMES.
We disclaim all liability for the accuracy, content, completeness, legality, reliability, or operability of information or content displayed in the App.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL JVW Retail, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (III) ANY CONTENT OBTAINED FROM THE APP; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.
You agree to defend, indemnify, and hold harmless JVW Retail and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:
a) your use and access of the App, by you or any person using your device;
b) a breach of these Terms;
c) your User-Generated Content; or
d) your violation of any law or the rights of any third party.
You acknowledge and agree that your use of the App is also subject to the terms and conditions of Google Play (or any other app store from which you download the App).
The SnapDash App is not intended for use by anyone under the age of 13. By using the App, you confirm that you are at least 13 years old. If you are under 13, you may not use the App. If we learn that we have collected personal information from anyone under the age of 13 without verifiable parental consent, we will delete that information as quickly as possible.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
These Terms constitute the entire agreement between us regarding our App and supersede and replace any prior agreements we might have had between us regarding the App.
